CRIMINAL LAW:

 

DWI

 

In a DWI matter in Morris County, Jonathan McMeen, Esq. successfully had the readings of the Alcotest machine dismissed due to the State failing to abide by procedures as set for by the Supreme Court of New Jersey in its State v. Chun decision. Specifically, there was a break in the “20 minute Observational Period” that was discovered by Jonathan McMeen, Esq. after a careful review of the discovery videos provided by the State.

 

Drug Possession – Heroin

 

In a recent matter in Sussex County, Jonathan McMeen, Esq. represented an individual who was found to be in possession of a large quantity of Heroin. The client was charged with a 3rd degree crime of Possession of Narcotics, which under the law, could subject the client to 3-5 years in prison. Through discussions with the Prosecution, Jonathan McMeen, Esq. successfully got the client admitted into the Pre-Trial Intervention Program (“PTI”). Under this program, the client had to abide by various supervisory conditions for a period of 12 months. Upon successfully completing this program, the client’s initial charges would be dismissed.

 

Assault

 

In a recent matter in Sussex County, Jonathan McMeen, Esq. represented an individual who was charged with assaulting another patron at an establishment in the county. After negotiations with the Prosecution, it was determined that the State could not successfully prove its case, and subsequently dropped all the charges against the client.

 

Probation Violation

 

In a matter in Sussex County, Jonathan McMeen, Esq. represented an individual who was charged with violating his probation for the third time, and was subsequently sent to jail with no bail. During a hearing in front of a Superior Court Judge, the state pushed to have the client sentenced for 4 years in prison. Jonathan McMeen, Esq. successfully argued in front of the Judge that the sentencing recommendation of the Prosecutor was disproportional to the actual facts of the case. The Judge agreed, and sentenced the client to a simple extension of probation for 1 year.

 

CIVIL LITIGATION:

 

Protective Order

 

In a lawsuit against a contractor, Jonathan McMeen, Esq. successfully blocked a Plaintiff homeowner from obtaining the Defendant contractor's personal tax returns, which were demanded by the Plaintiff during the Discovery Period. The Judge agreed with Jonathan McMeen, Esq. that these tax returns were not relevant whatsoever to the issues presented in the lawsuit, and subsequently signed a Protective Order.

 

Negligent Mechanic

 

Jonathan McMeen, Esq. represented a Plaintiff in a lawsuit against an automobile mechanic for a negligent engine repair. The client brought his commercial vehicle to have a spark plug repaired at the mechanic’s shop. After the repair was completed, the engine of the vehicle caught on fire after the truck was driven about a mile on the road. The engine was destroyed. After suit was filed, Jonathan McMeen, Esq. successfully negotiated a settlement that covered all the costs associated with repairing the damage to the client’s vehicle.

 

Plaintiff’s Case Dismissed

 

A Plaintiff contractor brought a suit against an individual, alleging unpaid invoices for plumbing services to the client’s home. Shortly after the commencement of the suit, Jonathan McMeen, Esq. propounded a request for documents on the Plaintiff. The Plaintiff’s attorney failed to deliver any of the requested documents to Jonathan McMeen, Esq. Subsequently, Jonathan McMeen, Esq. successfully had a Judge dismiss all of the Plaintiff’s claims for failing to provide the Discovery requested.
